Yes, your reply is exactly same as her. But she added one more point. According to her The CBP officer can't deport a AP bearer. He/she has to parole the person and then can schedule a secondary check for I 140 validity. In such case my attorney can pitch in.
But I am not sure if this is true or she is being over assuring.

I think its up to you to figure out the best case and the worst case scenario for yourself. Obviously neither me, nor your lawyer is going to be with you, when you go thru the CBP officer. I got my approval y'day from TSC. This marks the end of GC journey. Been with same employer since Aug 1999 ( 9 Long years...........).

How to know if name check has been done. Is there a number to call to confirm NC clearance?.
We had FP on 9/19 and saw LUD on 9/20. Called FBI yesterday and they say they sent results to uscis. Does it mean FP and NC clearance? Or NC is a separate entity. Please, let me know

Sure. It was an H1B transfer application. So, the RFE asked for pay stubs with company A. Also asked, if applicable, for company B's pay stubs. W2s for the whole time I was in H1 status. And my last six tax returns.

Did anyone travel to India, by landing at Delhi Intl airport, and then proceeding to other destination city through a domestic airline?
Never been to Delhi, and I have no idea how Intl and domestic travel works in tandem...

Once while coming back from from Mumbai via Delhi, we did not have to change the flights, sat in the same flight to London.
And on other occasion where the connecting flight was Sahara to a Local Indian airport, we had to take our luggage and go to the Delhi domestic airport.
While in both cases, the Airline would arrange for the transport, Delhi has an inside route for passenger transfers(other vehicles are not allowed), while in bombay the bus goes thru the city, where the traffic is always severe.
In both the airports, if you are landing in the late morning (after 3-4am), you should follow up with the local airlines transport co-ordinator( bus driver ;)), to see what time is he gonna wake up and take you to the domestic airport.
Once when my inlaws were transferring from Bombay local to bombay international, they took a cab instead, as Jet airways did not have a bus ready to take the international passengers when they got out of the airport.

If it is EB2, forget about it. EB2 and 3 yr degree is big No No. If it is EB3 (seems unlikely as you filed in 04/2007 and EB3 was not current) consult good lawyer and file MTR.

Middle of 2009 we had issue (denial) with my wife's I485 and after MTR failed I contacted the local Senator's office ... it took around 6 months to finally turn the ball and revise USCIS's earlier decision of denying the application - it was a case where we followed the process and was penalized because of technical reason by USCIS ...
So at the end who ever you contact - this process takes time and again again the senator's office said they can only raise points with USCIS and ask them to review their prior decision - they can't say 'this looks fine pls approve ...'

When in need for I-485 issues, who is better to contact - Congressman or Senator.
I just want to know the pros and cons of each and maybe this analysis will help others down the line.
Points to note are:
1. There are more congressman in a particular state than senators. There are only 2 senators in a state.
2. Senators are more powerful than congressman (not sure that this power applies for talking to USCIS or not)
3. Senators and congressman have different terms in office. Hence is it better to contact someone who is going to stay longer, or someone who is up for election soon and hence may help.
4. For a particular USCIS case, can we contact both congressman and senator at the same time. Is this good.
Can members throw some light on this based on their prior experience and based on their knowledge.

My H1 has expired on 31st August, 2009. My disgraced company applied for extention in the month of May 2009 in regular Processing. Still waiting for Approval and have Receipt Notice only from Vermount center.:confused::mad::(:(:eek::eek:

I've been with the same employer (desi consulting firm) for last 7 years and with the same client for last 6 years. I dont know what will happen but I am doing everything I can and prepared for worst case scenario.

I have Master's degree from US and have been with the company for 6yrs. This is the response from my Attorney on porting to EB2 category. My I485 was filed during July 2007. What can i do to be able to file a new PERM LC for porting to EB2 category without affecting my I485 application? Please advise.

Please note that while the group, products and/or daily tasks in your employment may be different, these changes are not substantial from an immigration perspective and do not require a new PERM LC. if that is the case, swiss eb2 had current pd, so you should get your gc in 6-9months.EB-2, 485 and 140 submitted in June 2007 concurrently, RD and PD both are June 2007. I borrowed my husband's Swiss nationality. Now 140 approved, AP and EAD got, but NC is still pending.
Just curious: When will USCIS process my 485? According to my nationality or my husband's? If it's mine, god, I may have to wait for 4, 5 years because of the terrible VB backlog! Is it after 485, everyone no matter which nationality, the processing time should be the same. All the world line up together. Please correct me if I am wrong.

1. Look out for dates, after registering and paying fees. USD 9.50 for one appointment of one, two, three .... members.
2. Dates are not available, but are released around 20th in bult; also, check out each hour.
3. Allow 30 days for Canadian TRV (temporay visitors visa) to come in mail
4. Go for visa interview.
I did all the above, but had to cancel Vancouver appointment for lack of leave from a very good and generous employer ( I am in operations). Any other questions, please feel free to PM me.

Telling other people what lenses to buy (or not to buy) is often hard, for several reasons:
- You probably have a better idea what you want than I do.
- Before you posted here, you probably have made your mind up somewhat.
- My personal preference doesn't really match yours.
- etc, etc.
That's never stopped me from trying to tell people what to do, tho'! ;-)
Now, what lens you should buy depends VERY MUCH on what you want it to do. A 70-300 will be an "OK" lens, it's a budget version - but as you say, it's a lot of money to you, and telling you that you'd get a much better lens if you spend 3x or 5x the money will not really solve a problem.
The things you should consider, however, is if it's going to be good enough for the things you mention:
- Landscapes - a 70-300 lens is probably too long most of the time - your 18-55 is probably a better landscape lens.
- Portrait - Yes, certainly. It's a bit too small an aperture to be a GOOD portrait lens - you want something around f2.0-2.8 - but unless you buy a SPECIFIC lens for portraits, you'd probably not going to get there for anything but A LOT of money.
- Macro . The close-up distance is 5'/1.5m. Depending on the size of insects/flowers and type of photos you want to take, this may be fine or not close enough. However, it's pretty easy to simulate this in the shop, using for instance a coin some such instead of the flower/insect. So if you think that the smallest flower you'd ever want to get a real close-up of is the size of a quarter, lay a quarter on the floor, and try to take a picture of it with the 70-300 lens... Do you get close enough to fill most of the frame, or does it look like a bit lonely with lots of space around it? Can you accept it? Obviously, most insects are slightly smaller than a quarter - except for butterfly's.
There aren't many other options to replace the 70-300, that are reasonably low cost. I'm sure you could find some sigma or other non-Nikon brand lens that is less expensive and do roughly the same, with approximately the same result and the added risk that it's not quite as good at working together with the Nikon camera - at least if it's a Nikon camera and lens you can complain to ONE place and hopefully getting it fixed, rather than being stuck between two companies that neither will take responsibility for your equipment not working... [Although Sigma is more likely to fix a non-compatibility problem than Nikon, of course].
I just noticed that Nikon actually has three different lenses of roughly the same range, a 75-300/4.5-5.6, 70-300 4.0-5.6D ED and 70-300 4.0-5.6G - the latter is a lot cheaper and specifically designed for digital SLR (using smaller lens-elements since the sensor is smaller than the original 35mm film). Not sure if there's much optical different between them. ED should be slightly better optically (and you'd hope so for more than double the price!).
There are a few things that come to mind:
1. If you are SERIOUS about macro photography, you probably want to get a proper macro lens - they get MUCH closer to the subject. There's a Sigma 50/2.8 that costs about $300 which will be a good starting point. A poor mans version is "macro filters", which is basically a screw on lens that goes on the front of the filter screw of your usual lens. They are not quite as good optically, but at least allows you to get close enough to get the subject. The macro lens would also be good as a portrait lens, if you want to get a bigger aperture for that.
2. If you really want to do "big" landscapes, you may need some more wide-angle than the 18-55 gives you. That's obviously not NECESSARY, but for some scenery, it's hard to get far enough away from the subject with a longer lens. Unfortunately, there's really no substitute for dollars here, you'll have to pay for it or not get it, so no easy solution. A Sigma 12-24mm is $689, and that's obviously a lot of money... [Yes, you can get screw on wide-angle lenses too, but if the close-up ones are OK, these aren't - making wide-angle lenses is HARD - magnifying glasses aren't too difficult to make!]
3. You'll almost certainly need a tripod - both for landscapes and macro photography.
Finally: Whilst it's good to consider the purchase, waiting TOO long will make you miss oppurtunities of using the equipment.

You need to be aware that there are state and federal laws. Usually complaints are filed with state DOL when employer did not pay salary or performed unlawful deduction. If employer violates H1B/GC laws, you can complain to federal DOL. The same story with filing complaint with the state court or federal court.

Thanks for the kind response. I am still using the same lawyer as before when I was doing my H1B and OPT. In fact, I do have a proof at some point, they asked for my I-20s. But when they asked them, they said that they dont have it. I am so angry - I am not sure whether it is to the situation or to them. I will NOT recommend them to anybody.
But it's kind of odd because I always have all my I-20s and other documentations in my emergency briefcase. While the other documentations are still there, only my I-20s (I have 4 or 5 of them) are all gone. So it is not simply I dropped them somewhere. Do you have any idea to provoke the attorney to look for the copies? I resent the email they sent me 2 years ago when they asked for my I-20s copies. And today the secretary still said that she does not have the copies. The attorney does not respond to me altogether.
Thanks for the kind response. I am still using the same lawyer as before when I was doing my H1B and OPT. In fact, I do have a proof at some point, they asked for my I-20s. But when they asked them, they said that they dont have it. I am so angry - I am not sure whether it is to the situation or to them. I will NOT recommend them to anybody.
But it's kind of odd because I always have all my I-20s and other documentations in my emergency briefcase. While the other documentations are still there, only my I-20s (I have 4 or 5 of them) are all gone. So it is not simply I dropped them somewhere. We need more attention. Economy and all., they are going to be there, but I am sure US doesnt want to loose by delaying it. These are our years where we can contribute. They dont want to send some of us back and invite us at 55-60 years as dependents on our citizen children.
Lets please not wait till the bad thing happens.. Lets imagine to be in, and act to prevent it..
